Transparent administration

The information published in this section is organised on the basis of the provisions contained in Legislative Decree No. 33 of 14 March 2013 (“Reorganisation of the regulations concerning the obligations of publicity, transparency and dissemination of information by public administrations”), which identify the essential level of the services provided by public administrations for the purposes of transparency, prevention, and combating corruption and maladministration – pursuant to Article 117, second paragraph, letter m) of the Constitution – and also constitute the exercise of the function of statistical and IT coordination of the data of the state, regional and local administration, pursuant to Article 117, second paragraph, letter r) of the Constitution. The provisions of the decree identify the transparency obligations concerning the organisation and activities of public administrations and the modalities for its implementation, in order to favour widespread forms of control over the pursuit of institutional functions and the use of public resources.

DPO-Privacy

Data Protection Officer

With the EU Regulation 2016/679, all public administrations and all companies that track users on a regular and systematic basis or process sensitive data on a large scale will have to have a ‘data protection officer’, who according to Article 37 of the new text must be ‘designated on the basis of professional qualities, in particular specialist knowledge of data protection law and practice’.
The ‘Data Protection Officer – DPO’ is therefore an expert who must be able to advise company management on the requirements of the law on the protection of personal data, and then ensure that these are correctly applied, also acting as a point of contact with the Privacy Authority and with data subjects.
The Privacy Guarantor has, on several occasions, clarified (see Privacy Guarantor website) that there are no compulsory qualifications or particular qualifications to perform this role.
